Core principle of a liberal democracy: role of gov should be limited through the S.O.P along with checks and balances due to the corrupting nature of power - Federal gov limited by const, cannot infringe on states or citizen rights - 1st amendment freedom of expression and religion - 10th: any power not given to fed by the const is reserved for the states or the people - Reps want to reduce 'big gov'
AA had a series of challenges in the Supreme Court, arguing it breaches 14th amendment, not declared unconstitutional however it was restricted University of California v Bakke 1978 - Ended use of quotas Schuette v Coalition to Defend AA 2014 - Rejected a challenge to deny Michigan state's initiative that replaced AA - AA was thus cancelled and Michigan's new program started
Presidents can be affected by the extent to which they hold an electoral mandate to govern - Some are elected on strong wave of support for their policy and vision meaning they are more likely to acheive their policy goals - Presidential policy implementation success rates and their overall popularity typically fall as they move further from original mandate - With a decisive majority in Congress however it is likely the a president can overcome any possible limitations due to their mandate
Power of the states slowly eroding, turning point was the 1929 Wall st crash. Roosevelt introduced his 'New deal policies' which meant federal gov had more control - Interconnected as they both govern US, even share some policy areas such as the provision of basic infastructure eg roads - Federal gov distributes funds to states through grants to carry out policy that it wants to see. Eg 2009 Obama Race to the Top initiative: states compete for $4.3bn in grants based on educational targets
