Liability that occurs when a person breaches a duty to conform to a particular standard of conduct with others. It is such a departure from what would be the conduct of an ordinarily careful and prudent person under the same circumstances to establish evidence of indifferenece to the consequences of ones actions. (An example: The hunter who shoots his hunting partner and his actions reflect a person who behaved unlike an ordinary careful and prudent hunter would.)
