Major legal and constitutional developments 1. UK (The Electoral Commission) - The Political Parties, Elections and Referendums Act 2000 required all parties to register with the Electoral Commission - Transparency of Lobbying, Non-Party Campaigning and Trade Union Administration Act 2014 -> regulated outside influence as any groups spending over 10k must register with the electoral commission - 2015 Parliamentary candidates could only spend 30k in their main campaign 2. US (The Federal Election Commission) - Federal Election Campaign Act 1974 -> introduced max donations, expenditure, presidential expenditure limits and a federal funding system - The Bipartisan Campaign Reform Act 2002 attempted to close the loopholes of FECA eg soft money - Citizens United v FEC 2010 undermined BCRA by allowing the creation of Super PACs through overturning a portion of the regulation - No limit on campaign expenditure unless presidential candidate is accepting federal funding
Powers denied to congress - 10th amendment - Amendment process
Prevents any one person, party or institution from holding all the power - Ensures all interests considered -> common for different parties to control -> more inclusive policy - However -> may just be political gridlock -> no policy implemented leaving all voters worse off
Sovereign constitution allows US courts to overturn the actions of any institution, even Congress -> whereas in the UK Parliament an overturn any judicial ruling with relative ease - Because the US constitution is entrenched court rulings are not easily overturned by political bodies -> in the UK politicians can easily pass new acts overturning the courts - It depends on the willingness of judges to enforce such liberties on the basis of their own interpretations
