1. Inefficiency or low ouput - Results from arguably excessive checks and compromise - Congress cannot act quickly on key needs 2. High levels of partisanship - Means parties are unwilling to agree which leads to even greater gridlock 3. Poor quality legislation - Can arise due to too much compromise and dilution of bills - May be financially wasteful due to pork-barrelling

Judges in both countries have high levels of independence through the security of tenure, allows them to exercise power freely without the fear of political reprecussions - Arguably the appointment process in the US undermines the independence of the court, the president and the Senate ratification system causes a political bias in the Supreme Court and politicises the whole process - In the UK judges are appointed through the Judicial Appointments Committee which ensure the independence of the appointments - In both countries, high-profile cases means there are usually external pressures, in the UK the government cannot criticise the decisions made by judges however this is common place in the US
Article II of the constitution outlines the need for an electoral college to act as a check on the public How does it work? - Each state has a value of ECV based on number of congresspersons and senators - Candidates compete on a state by state basis -> winner receives all votes from that state - To win a candidate needs 50%+ of the ECV (270) - Larger states have more ECV although it is not directly proportional to population - In 21 states ECV's not legally binding - Should there be a draw the House and Senate get to vote and decide, this has happened twice
