Judicial activism is criticed for giving justices excessive power over politicians - Restraint seen as more democratic as it restricts the liklihood of unelected justices denying a majority of elected politicians with a mandate - Conservatives in particular have criticised activism as the court 'finding' new rights eg abortion - Supporters of judicial activism base their ideas around protection of civil liberties and an outdated constitution -> adapt to modern society
Judicial - Can only apply the constitution and the law which is created by politicians, justices are not able to initiate cases - Areas which court cannot act in eg annual budget or presidential military strategy, also unlikely for any intervention in foreign policy / defence Political - Justices have a big political impact, affecting power of political institutions, rights of individuals - The Court is often likened to a policy maker for it appears to use personal values to pursue its policy goals
The Head of State is the chief public representative of a country - Diplomatic and ceremonial duties such as visiting dignitaries and other heads of state tend to be involved - President is often a focal point in times of crisis - While this does not provide formal powers it does allow the extension of authority - The president is seen as a national leader who can direct foreign policy, the rise of the national media has allowed the president to deliver nation wide speeches which place influence on public opinion -> used by Trump frequently
The president can instruct the executive branch to carry out / not carry out certain policies without congressional approval - Effectively creating policy without Congress - Trump in 2017 with his Travel Ban, Bush with the creation of military tribunals which led Guantanomo Bay - The scope of the orders are limited, the president cannot pass new laws but only enforce current laws or bend shape them to a degree - All the orders are effectively removed when a term ends
