1. State power erosion - Federal mandates What are they? Why do they limit power? How do they harm states and why? ACA

Protects key principles of the political process: basic democratic ideas should be preserved eg s.o.p and elections - Protects states and upholds federalism: states rights entrenched - Prevents abuse of power through ensuring no one individual can change const for their own gain - Prevents ill-thought out amendments considering the difficulty and compromise necessary only the most effective and popular proposals will be enacted
Partisanship had a major impact on presidential power, under divided government the persident may fail to provide significant leadership and thus face congressional opposition -> Happened much through Obamas term with a rep led congress - On the other hand, if there is a unified government, this will lead to an increase in the presedent's power -> driven by loyalty there may be less pressure on executive oversight -> eg Bush admin after 9/11
Federal laws which Congress can impose as a national standard on all states -> state powers limited as forced legally to comply - Increasingly common - Can also harm states financially as they may have to pay for the policy imposed upon them - Eg: Affordable Care Act 2010 required all citizens to have health insurance which they could buy at health exchanges set up and paid for by the state
1. FPTP and gerrymadering - Both heavily undermine the representative nature of congress - Determination by parties and politicians to maimise their own power has led to major distortion where power distribution does not accurately represent the will of the people 2. Social representation - Composition of congress does not match that of society, particularily race and gender - Importance is debated, non-whites makeup 38% of the population and only 10% of the Senate - Can undermine the interests of social groups - On the other hand, the most recent congressional session is the most racially diverse ever 3. Influence of pressure groups - Congress is influenced by pressure groups in a manner that arguably distorts the public wishes - Politicians responding to the will of pressure groups gives them a disproportionate amount of representation - The significance of money means richer groups tend to dominate -> providing further sway in the direction of elitist groups
