1. The president - The president can veto legislation passed by Congress - Needs 2/3 majority to repeal - Obama veto of the repeal of Obama Care in 2016 2. Partisanship - Has decreased the will of the parties to compromise - Laws therefore much harder to pass - Eg Democrats and Republicans could not agree on the terms of the Fiscal Budget in 2013 despite consequences of the government shutdown 3. Supreme Court - Can overturn Acts of Congress using judicial review
1. FPTP and gerrymadering - Both heavily undermine the representative nature of congress - Determination by parties and politicians to maimise their own power has led to major distortion where power distribution does not accurately represent the will of the people 2. Social representation - Composition of congress does not match that of society, particularily race and gender - Importance is debated, non-whites makeup 38% of the population and only 10% of the Senate - Can undermine the interests of social groups - On the other hand, the most recent congressional session is the most racially diverse ever 3. Influence of pressure groups - Congress is influenced by pressure groups in a manner that arguably distorts the public wishes - Politicians responding to the will of pressure groups gives them a disproportionate amount of representation - The significance of money means richer groups tend to dominate -> providing further sway in the direction of elitist groups
Men and women are fairly evenly split between the 2 main parties, however there is a long standing pattern where more men support the Republicans and women the democrats -> men tend to be more conservative whilst women more liberal rights - Eg Obama introducing Fair Pay Act which was opposed by almost all republicans
1. The president and Congress recieve seperate mandates - Both feel they have the right to govern, this means they are less likely to give in to eachothers demands -> Congress arguably has the greater mandate as the house is elected every 2 years 2. Limited patronage over individual members of congress - As the 2 branches are seperate if a congressional member defies their president there is little that any president can do 3. The potential for divided government - It is not uncommon for the presidency to be controlled by one party and atleast one chamber in Congress to be controlled by the other -> this restricts the president and makes compromise a necessity
