1. There are two main ways of getting into federal court. What are they?

Provides the reason given for a courts judgment, finding, or conclusion as opposed to the decision, which is the judgment itself. Opinion of a court implies its adoption by a majority of the judges. A single judge usually writes opinions and if there were more than one judge deciding the matter, as in an appeal to a three member appellate tribunal, other judges will join in the opinion.
1.) Same claim COA pursued: Broadly defined by courts. Best to join all claims to claim you are initially seeking. If you don't may lose ability to sue for claim later. Ancillary jurisdiction: supplemental jurisdiction; - 2.) Same parties: real parties and interest. Can't have parent sue on behalf of minor and then minor turn and sue when an adult. - 3.)Decided by court in final judgment: temp orders. Tempt injunction. Would not be final judgment. (out of court settlements either) - 4.) Based on the merits: substance of the case not dismissed or technical/procedural reason.
DIVERSITY JURISDICTION, and FEDERAL QUESTION - - - Federal questions, plaintiff show right or immunity under federal law and fed question be basic element of cause of action. Cant be incidental or collateral and cant arise as counterclaim on the part of the defendant
Judgment: the determination of a court of competent jurisdiction upon matters submitted to it. A final determination of the rights of the parties to a lawsuit. Legal circles favor spelling as judgment instead of judgement. Default Judgment: judgment entered on behalf of a plaintiff when the defendant defaults, or fails to appear in the proceeding. Erroneous Judgment: Estoppel by Judgment: estoppel brought about by the judgment of a court, the essence of which is that a similar question of fact presently in dispute has been previously determined by a court of competent jurisdiction between the same parties, or privies. Final judgment: conclusively determining the rights of the parties and disposing of the entire controversy before the court, or of some separable portion thereof, so that, immediately after the judgment or an appeal therefrom is rendered, the only judicial business that remains is enforcement of that judgment. The term also refers to the sentence imposed in a criminal case. Judgment on the Merits: judgment rendered on through analysis and adjudication of the factual issues presented, rather than by the existence of a technical or procedural defect that requires one party to prevail. A judgment on the merits is binding and issues so adjudged become subject to the force of res judicata and collateral estoppel. Judgments not rendered on the merits are frequently considered dismissed without prejudice so that the factual issues may eventually be decided upon.
