Plaintiff can be the one to change domicile and to so solely to go to fed court (forum shopping) once diversity established can't lose it unless independent parties that destroy diversity. And another (get from Shane) parties improperly or inclusively conjoined to gain diversity, can't move to destroy it from moving afterward. Must be complete so plaintiffs must be complete from all defendants. Multi party lit is the primary reason for such. Diversity depends only on the named party or plaintiff. If all from same state in the class action lawsuit it will not qualify. Fed ducat is crowded and fed courts must apply state law in diversity cases. Must know fed and state laws then. If amount plaintiff wins may not get cost, attorney/court costs wont be covered. If though congress can raise amount in controversy but cant do away with it. - Interpleader: usually involves insurance policy or claim and beneficiary cant be located. Go into court don't know who to appropriate the claim to do so the court assists in determination. - Collusive: create new example not Hagles's - Stockholders are citizens and members of the corporation thus this legal fiction and went to the wayside. Corporations may have dual citizenship though if main place of business is different than HQ. Principal place of business center is nerve center not where most of the business is done. Exception to main domicile. - Unincorporated entities: domicile of individual constituents. - Ancillary jurisdiction: joining of issues and parties (COVER IN DEPTH) - Pendent jurisdictions: add claims p or d may have that are state based that must be fed question now called supplementary jurisdiction. Can use diversity jurisdiction cant really aggregate individual - Common nucleus of op facts: case has to be essentially same evidence related in claims filed. - Domicile: place at which person is physically present and or home. Not a mere residence
